Never accept a buyout offer under pressure without speaking to an attorney first. You may be giving up rent-controlled housing rights worth thousands of dollars annually.
Overview
Landlord harassment is the use of intimidation, interference, or illegal tactics to force a tenant to move out โ often to re-rent at a higher rate or redevelop the property. California law prohibits a wide range of harassing behaviors and entitles victims to significant damages. Many cities have their own stronger anti-harassment ordinances.
๐จ Types of Landlord Harassment
Changing locks, removing your belongings, or blocking access to your unit without a court order.
Cutting off water, gas, electricity, or other utilities to force you out.
Entering your unit repeatedly without 24-hour written notice (except emergencies).
Deliberately withholding repairs to make the unit uninhabitable so you'll leave.
Threatening eviction, physical harm, contacting immigration authorities, or other intimidation.
Removing parking, laundry, storage, or other services included in your lease.
Pressuring you to accept cash to leave using deceptive or intimidating tactics.
Scheduling noisy or disruptive construction during unreasonable hours or without proper notice.
โ Key California Laws
Prohibits landlords from using intimidation, coercion, or harassment to force tenants to vacate. Entitles tenants to actual damages + 6 months rent + attorney fees.
Makes illegal lockouts and utility shutoffs a misdemeanor. Entitles tenants to $100/day in statutory damages during the lockout period.
Limits landlord entry to situations with 24-hour advance written notice during normal business hours. Repeated unauthorized entry is harassment.
Implies a covenant of quiet enjoyment in every tenancy โ the right to peacefully use and enjoy your home without landlord interference.
SF, LA, Oakland, and other cities have dedicated tenant harassment ordinances with stronger protections and higher penalties.
What To Do โ Step by Step
Keep a written log with dates, times, descriptions, and witnesses. Save all texts and emails. Photograph any physical changes to your unit (broken locks, removed appliances). Video is powerful evidence.
Put your landlord on notice in writing that their conduct is illegal and must stop immediately. Cite the specific laws being violated. Send by certified mail and keep a copy.
An illegal lockout is a crime. Call police and request they document it. You have the right to be let back in immediately. Officers can accompany you.
Report to your local housing department, city attorney's office, or rent board. In cities with harassment ordinances (LA, SF, Oakland), file with the relevant city agency.
Civil Code ยง1940.2 allows you to sue for actual damages, 6 months' rent, and attorney fees. Illegal lockouts under ยง789.3 add $100/day. These cases often settle quickly once filed.
